Terms and Conditions of Use for Mini Hotel PMS Service

Welcome to Mini Hotel PMS. By registering and using our services, you agree to comply with the following terms and conditions. If you do not agree with any of these terms, please do not use the service.

1. Definitions

  • “Mini Hotel PMS”: The provider of the hotel management software service, operated under the SaaS model.
  • “The Client” or “User”: The individual or legal entity that uses the software and/or services provided by Mini Hotel PMS.
  • “The Service”: Access to and use of the cloud-based software for the operational management of tourist accommodations.
  • “Content”: All information, data, texts, images, or other elements uploaded or processed by the Client within the system.

2. Purpose

Mini Hotel PMS provides a Software as a Service (SaaS) platform that allows hotels, hostels, and other properties to manage reservations, billing, check-in/check-out, reports, and other operational aspects.

3. Registration and Account

  • Use of the service requires registration and account creation.
  • The Client is responsible for maintaining the confidentiality of their credentials.
  • The Client must provide true, complete, and updated information.

4. Scope of Service

  • The service is provided exclusively in SaaS mode, through remote internet access.
  • Mini Hotel PMS commits to maintaining 99% monthly availability, except for scheduled interruptions or force majeure events.
  • The Client accesses the system from any device with an internet connection, without the need to install local software.

5. License to Use

  • Mini Hotel PMS grants the Client a non-exclusive, non-transferable, and limited license to access and use the software.
  • Reproduction, modification, distribution, reverse engineering, or any form of unauthorized exploitation of the software is prohibited.

6. Fees and Billing

  • The Client agrees to pay the current fees according to the contracted plan, on a monthly or annual basis.
  • Fees may be updated with at least 30 days’ prior notice.
  • Failure to pay may lead to the suspension or cancellation of the service.

7. Intellectual Property

  • The software, its source code, design, interfaces, and documentation are the exclusive property of Mini Hotel PMS.
  • Data entered by the Client (reservances, clients, billing, etc.) are the property of the Client.

8. Confidentiality and Data Protection

Mini Hotel PMS undertakes to treat Client data with confidentiality, in accordance with applicable data protection regulations. Technical and organizational measures are implemented to ensure data security.

9. Technical Support

Technical support is offered via email, chat, or phone according to the contracted plan. Response times are detailed in the corresponding SLA (Service Level Agreement).

10. Liability

Mini Hotel PMS will not be liable for indirect losses, loss of profits, or interruptions caused by external, technical, or third-party failures.

The total liability of Mini Hotel PMS shall in no case exceed the amount paid by the Client in the 3 months prior to the claimed event.

11. Term and Termination

The contract becomes effective upon acceptance of this document and remains in force as long as the Client continues to use the service.

The Client may cancel the service at any time. Mini Hotel PMS reserves the right to cancel the service in the event of contractual breaches.

12. Modifications

Mini Hotel PMS reserves the right to modify these terms with 15 days’ prior notice to the email address registered by the Client. Continued use of the service after the indicated period implies acceptance of the new terms.

13. End-User License Agreement (EULA)

13.1. License Grant

Mini Hotel PMS grants the Client a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the software in accordance with these Terms and Conditions.

13.2. Use Restrictions

The Client agrees not to:
a) decompile, reverse engineer, or modify the software;
b) use the software for purposes other than those authorized herein;
c) remove, alter, or obscure any intellectual property notices.

13.3. Updates and Maintenance

Mini Hotel PMS may, at its sole discretion, provide updates, enhancements, or bug fixes to the software, which will be considered an integral part of the software and subject to this EULA.

13.4. Proprietary Rights

The Client acknowledges that all rights, title, and interest in the software, including its updates and documentation, belong exclusively to Mini Hotel PMS. This license does not transfer any intellectual property rights to the Client.

13.5. Limitation of Warranty

The software is provided “as is,” without guarantees of uninterrupted or error-free operation. Mini Hotel PMS does not guarantee specific results from the use of the software.

13.6. Termination of EULA

This EULA will remain in effect as long as the Client uses the service. In case of service cancellation or breach of the conditions set forth herein, the Client must cease all use of the software and delete any local copies that may exist.

13.7. Modifications to the EULA

Mini Hotel PMS may modify this EULA by providing at least 15 days’ prior notice, in line with the provisions of section 12. Continued use of the software will imply acceptance of such modifications.
